Returns
A consumer (a natural person acting outside their trade or business) has the right to withdraw from a distance contract within 14 (fourteen) calendar days of receiving the product, without giving a reason. The period is preclusive and starts on the day the product is handed over to the consumer or to a third party who is not the carrier.
To exercise the right of withdrawal, the consumer must inform us of the decision before the deadline, by an unequivocal statement sent by post or email in the form of the withdrawal form. On withdrawal, each party must return to the other what it received under the contract.
The consumer must return the product without undue delay and no later than 14 days from the day the withdrawal statement was given. Missing this deadline results in the loss of the right of withdrawal and the right to a refund. The consumer bears the cost of returning the product. The consumer also bears any diminished value of the goods (Article 77 of the Consumer Protection Act): unpacked goods, lost documentation and parts, damage, use of the goods and similar, except for what was necessary to establish the nature, characteristics and functioning of the product.
If the product is returned defective, with significant damage or without parts and documentation, and if these are not delivered within an additional period of 8 days, the buyer is deemed not to have fulfilled the obligation to return the goods, and Peloza d.o.o. is not obliged to refund the amounts paid.
Peloza d.o.o. will issue the refund only after the product has been returned, or after the consumer provides proof that the product has been sent back in the same way it was delivered. The refund is made using the same payment method the consumer used.
The right of withdrawal under the Consumer Protection Act applies to consumers (natural persons). Business buyers (legal entities and sole traders purchasing for their business) do not have this statutory right, but a return can be arranged by agreement.
